– The African National Congress in the Eastern Cape has welcomed the Makhanda High Court judgment dismissing an application seeking to nullify its Local Government Elections candidate list.The application, Case No: 2026-228155 – Jojiyasi & Mambulu vs ANC Eastern Cape PEC and others, was dismissed by Judge Rugunanan.
ANC Provincial Spokesperson, Comrade Yanga Zicina, said the judgment is a decisive vindication of the ANC’s internal democratic processes.”This judgment constitutes a decisive vindication of the integrity and robustness of the ANC’s internal democratic processes. The Court correctly found that the applicants failed to establish any basis for judicial interference in the internal affairs of the ANC,” said Zicina.

Zicina said the ANC had argued in court that the candidate selection process was conducted strictly in accordance with the ANC Constitution and its Election Guidelines and Rules, and that all disputes lodged within the prescribed 48-hour period were duly adjudicated by the Provincial List Committee.
“The applicants lacked locus standi and there is no merit in this application on all possible grounds. The forensic audit commissioned by the NEC following the unauthorized alteration of the NEC-approved list between 27 and 28 August 2026 was a responsible, transparent and necessary intervention to safeguard the integrity of the list,” Zicina said.
He added that the court application was defective, legally doomed and an abuse of court process, as urgency was self-created with no cogent reason for bypassing internal remedies.”The Court’s decision to dismiss the application confirms what the ANC has consistently maintained from the outset, that the process from Branch General Meetings, to community presentations, PLC vetting and screening, Extended PEC ratification and final Extended NEC ratification in August 2026, was free, fair, credible and procedurally sound,” said Zicina
.Zicina said there are no winners or losers in the process and called for unity.”We extend a hand of unity and call upon them to join us on the ground as we campaign for an overwhelming and decisive victory. Our collective task now is to ensure that all ANC candidates emerge victorious and that we secure every municipality in the province.
“He urged members and supporters to respect the judgment, close ranks and unite behind democratically elected candidates.”2026 is the Year of Decisive Action to Fix Local Government and Transform the Economy, a message we will carry with determination to the 4th of November and beyond,” Zicina concluded.
